1. Introduction

1.1. These Terms and Conditions of Hire are a contract between Primetrack Short Stay ("us", "we", "our"), and you the person making the booking and all adult members of your party who will be staying in any of our apartments ("you", "your", "client", “guest”).

1.2. By making a booking or staying in one of our apartments you agree to abide by these Terms and Conditions of Hire.

2. Terms & Conditions

2.1. Acceptance of Terms & Conditions

2.2. All bookings accepted by Primetrack Short Stay are subject to these terms and conditions, which are to be accepted by the hirer and other parties involved. When you make a booking with Primetrack Short Stay you agree with the general conditions.

2.3. Prices and availability are subject to changes and may be subject to a minimum number of nights stay as well. By completing payment of rental fee(s) or (damage) deposit, these terms and conditions will be considered to be accepted by the parties involved.

3. Payment

3.1. Prices used are in Euro’s, unless specifically mentioned otherwise.

3.2. Payment for reservations is required to fully complete the booking process

3.3. When it comes to a rental period shorter than 7 nights the full payment is required. The total rental fee, including taxes and service costs, is required to be completed before or upon arrival to enable confirmation of booking.

3.4. When it comes to reservations of seven (7) nights and longer a down or full payment will be required. This down payment is the equivalent of 50% of the agreed rental price for the entire rental period. The full or down payment must be received by Primetrack Short Stay within 24 hours of confirmation of the reservation by Primetrack Short Stay.

3.5. Payments can be completed by bank transfer (at least 7 days prior to arrival) or by using a credit, debit card or bank transfer. In order to be guaranteed a (damage) deposit is required, this is also called a security deposit.

3.6. Upon or before arrival at the apartment a security deposit is to be paid where the amount depends on the duration of stay. This security deposit together with the total rental fee must be paid during check-in. The security deposit is as follows:
– Stay of less than 3 nights: N 50,000– deposit
– Stay between 4 and 10 nights: N 75,000, – deposit
– Stay of more than 10 nights: N 100,000, – deposit

4. Services and taxes

4.1. VAT (7.5%) applies however are not included in the rental price, and will be charged separately, unless specifically mentioned otherwise.

4.2. For bookings of 7 nights and longer, weekly cleaning is included in the rental fee (once a week for two hours unless specified otherwise). Weekly cleaning includes a change of bed linen and towels, free of charge. End cleaning is applicable for bookings of 7 nights and longer. End cleaning fee of N 20,000,- is not included in the rental price and will be counted separately.

5. Facilities

5.1. All apartments are fully furnished and equipped. This includes a fully equipped kitchen, with cutlery and kitchen utensils present in the apartment.

5.2. Working Wi-Fi is complementary. Primetrack Short Stay however can’t be held responsible for loss and/or disturbance of the internet connection. When the internet connection is lost, Primetrack Short Stay will guarantee to do everything within its power to fix the connection as soon as possible.

5.3. Rental fee also includes gas, heating, electricity, water and television. All appliances in the apartment, e.g. lights, heating etc. are expected to be switched off when not in use. Excessive use of gas, water or electricity could result in extra costs.

5.4. Power outside the public utility provided electricity shall be provided as follows:
- 6:30 pm to 8:00 am: Private power provided by utilizing the back-up generator [All loads permissible]
- 8:01 am to 6:29 pm: Private power provided by utilizing the Solar inverter system [Lighting and socket loads only permissible]
- Power by the generator outside the 6:30 pm to 8:00 am can be provided by Primetrack Short Stay at a flat rate of N3.000 per hour.

6. Cancellation

6.1. Notification of cancellation needs to be presented to Primetrack Short Stay in writing. When notification of cancellation is received up to 7 days prior to the arrival date of the booking concerned, no costs will be involved.

6.2. In the case of cancellation less than 7 days prior to arrival, or in case of a no-show, the full amount of the reservation will be charged.

6.3. When it comes to bookings of 30 nights and longer, 30% of the total rental price after booking confirmation is non-refundable.

6.4. Primetrack Short Stay shall endeavour to rent out the property again for the concerning cancelled rental period. If Primetrack Short Stay succeeds in (partially) doing so, the rental fee for number of nights rented out again during the previously cancelled period, shall be refunded. Please note that Primetrack Short Stay will give priority to renting out other vacant properties.

7. Early departure

7.1. When it comes to bookings of 3 nights or less, early departures involve costs. When the guest decides to leave prior to the end date mentioned in the original reservation, the total rental amount will be charged and the reservation will be ended on the confirmed new departure date.

8. When it comes to bookings of 4 nights and longer, early departures can be subject to extra costs.

If a booking is to be cancelled prior to the departure date, the number of nights between the cancellation/ notification date and the end date mentioned in the original reservation will be charged, with a maximum of 2 nights over the proposed end date. Furthermore the reservation will be ended on the adjusted departure date.

8.1. The nightly rate offered by Primetrack Short Stay will be determined on the basis of the duration of your booking. This means that as the length of the reservation increases, the used nightly rate decreases. In case of an earlier departure, Primetrack Short Stay is authorized to charge the difference between the standard nightly rate and the nightly rate used for the applicable booking.

The standard nightly rates can be found below for Agip Estate Brick House
One (1) night Booking:
– Three bedroom duplex : N 60,000,- per night, excluding 7.5% VAT.
Within three (3) to seven (7) nights night Booking:
– Three bedroom duplex : N 55,000,- per night, excluding 7.5% VAT.
Above seven (7) days
Bookings above seven (7) shall be negotiated with Primetrack short stay.

9. Damage to the apartment or its contents

9.1. The tenant is expected to take responsibility for the property and its content (e.g. furniture, utensils etc.). This also means the property is left clean and in good condition upon check out.

9.2. Please ensure you inspect the Apartment on check-in. Unless we receive notification otherwise within three hours of check-in we will be entitled to assume that you have fully accepted that the condition of the Apartment is in good repair, condition and in a clean and tidy state and you will waive any right to claim otherwise.

9.3. Risk of damage to the Apartment and its contents will pass to you on check-in and remain with you until the Apartment keys are returned to us. You shall be liable for all loss and damage (except fair wear and tear) caused during the rental period, and for any reasonable loss of rental resulting from such loss or damage.

9.4. A security deposit to cover your obligations under this Agreement may be taken at or prior to check-in. Any security deposit paid will be returned to you in full (or payment authorisation cancelled) upon the Apartment being returned to us in accordance with the terms of this Agreement. Where you are liable for loss or damage or loss, we may withhold some or all of your deposit to cover the same and our administration fees associated with repairing or dealing with the loss or damage. These will be Additional Charges.

9.5. If you are found to be in breach of these Terms and Conditions of Hire at any point during your Booking and/or within 48 hours of check-out, you will forfeit the full security deposit paid to us.

9.6. In the case of damage to the apartment or its content due to actions of the tenants, their negligence or irresponsible behaviour, damage has to be reported to Primetrack Short Stay immediately. Primetrack Short Stay remains the right to charge the full amount of the damage caused. The costs of repair or replacement need to be agreed upon with Primetrack Short Stay and paid to Primetrack Short Stay in full.

9.7. In the case of normal run out of the apartment and / or its contents, no damage deposit will apply.

9.8. When the keys of the apartment are lost by the guest, a N 20,000,- fee will be charged to the guest.

9.9. When the apartment is left in extraordinary filthy state an extra fee will be charged to the guest by Primetrack Short Stay. This fee will be equal to the actual costs made in order to clean the apartment.

9.10. In case of damages in the property, tenant is required to inform Primetrack Short Stay immediately in writing or by telephone. Primetrack Short Stay will always seek to solve the damages as quickly as possible.

9.11. It is strictly forbidden for tenant to carry out repairs on or in the property. In case this happens, tenant will be liable for total repair costs.

9.12. The Operator shall have no liability whatsoever (whether for breach of contract, tort (including but not limited to negligence) or breach of statutory duty) for any loss of profit, loss of or damage to goodwill, increased costs, loss of anticipated savings, loss of business, loss of reputation, theft of, loss of or damage to the Client or Guest’s property and any special, indirect or consequential losses or damages, and in any event, our total aggregate liability for all losses or damages suffered or incurred by the Client or Guest (whether arising through breach of contract, tort (including but not limited to negligence) or any breach of statutory duty) shall not exceed the aggregate Agreed Price paid by the Client.

10. Our liability for Death, Personal Injury, Loss of Property, Lack of Services etc.

10.1. We shall have no liability to you for the death or personal injury to you or any members of your party.

10.2. Any guests using their own electrical appliances (hair-dryers, curlers, tongs, shavers, personal computers, personal stereos etc.) must use the appropriate adaptor. Non-UK plugs used without the appropriate adaptor/transformer are a serious fire risk. Please ensure that all heated appliances are switched off and stored safely before leaving the apartment. Guests found to be in breach of this clause may be asked to leave the immediate effect.

10.3. You must take all necessary steps to safeguard your personal property and we accept no liability to you in respects of damage to, or loss of, such property unless caused by negligence on our part.

10.4. Cars and their contents are parked at the owners’ risk. Please ensure that cars are locked and possessions are left out of sight.

10.5. Property left in the apartment will be kept for 1 week after departure or forwarded at the Guest’s expense. Any property will be disposed of after this 1-week period.

10.6. Save where there is total failure to provide useful accommodation as reasonably expected under this Agreement, we cannot be held responsible for any failure or interruption of services to the Apartment, for example, gas, water, and electricity, lifts, or for any damage, disturbance or noise caused as a result of maintenance work being carried out in any part of the building.

10.7. We shall have no liability for any loss which was not foreseeable at the time we entered this Agreement or losses not caused by our breach of this Agreement, and, if you are entering this Agreement in the course of a business, we shall have no liability for any loss of profit, loss of or damage to goodwill, increased costs, loss of anticipated savings, loss of business, or any special, indirect or consequential loss (whether arising through breach of contract, tort including (without limitation) negligence, or breach of statutory duty. In any case, our total liability to you is limited to the total cost of your reservation.

10.8. All descriptions and photographs of the Apartment are for illustration only and we do not warrant that they are accurate or complete, although we do use all reasonable endeavours to ensure that they are.

10.9. We do not exclude liability for fraud, and your legal rights are not affected by any term in this Agreement.

11. Wireless Broadband Internet and Entertainment Hardware

11.1. Wireless Broadband, a Television with Freeview channels and DVD player are usually available in all our apartments, however, we will not be liable for loss of this service due to connection, environmental or human error and no support service is available.

11.2. Wireless Broadband, a Television with Freeview channels and DVD player are not a contractual provision of this Agreement.

11.3. We do not assume any responsibility for any damage to your computer or the data contained on it, nor the security of any data transferred over the internet. Guests are responsible for the protection of their computers from loss of data, unauthorised access or viruses.

12. Usage and Nuisance Behaviour

12.1. The Apartments cannot under any circumstances be used for:
12.1.1. partying
12.1.2. playing loud music; or
12.1.3. general nuisance behaviour

12.2. Guests must have regard for all other occupants in the building.

12.3. Music, TV and general noise in an apartment must be kept at a reasonable level after 10 pm and before 11 am.

12.4. We reserve the rights to terminate your stay immediately if it is deemed that any such behaviour has occurred.

12.5. In the event of such a breach, we will remove all occupants from the Apartment, the police may be called, and you will be charged for any damage either to the Apartment or any neighbouring property which may have suffered damage, as an Additional Charge.

12.6. No refund will be issued if any or all Guests or visitors are removed from the Apartment for nuisance behaviour or for any breach of these Terms and Conditions, and any Security Deposit will not be refunded.

13. Smoking

13.1. Smoking is not permitted in the Apartment under any circumstances.

13.2. Smokers must vacate the building should they wish to smoke.

13.3. Where there is evidence of smoking within the Apartment, we reserve the right to charge the Guest or Client N40,000 for specialist cleaning, as an Additional Charge.

13.4. If a Guest is found to be smoking in the Apartment, they will receive a warning from us, we reserve the right to remove any Guest who is found to continue to smoke in the Apartment after that warning and no refund will be issued for the Booking.

14. (Number of) occupants

When it comes to our guests: only the number of persons mentioned and known to Primetrack Short Stay because of the fact that they are mentioned in the reservation confirmation, are allowed to stay in the apartments of Primetrack Short Stay. Primetrack Short Stay remains the right to refuse access to the hirer and his company if this condition is violated.

15. Modification of bookings

15.1. Primetrack Short Stay will endeavour to alter bookings if the guest wished to do so. Changes to reservations made can however not be guaranteed by Primetrack Short Stay.

15.2. Extension: Primetrack Short Stay offers in-house guests the opportunity to extend their stay before accepting new bookings. Please notify Primetrack Short Stay in writing at least 14 days prior to the end date of your original booking.

15.3. Primetrack Short Stay is a company that is active in seasonal business that is linked to trends in corporate housing. Therefore, in case of an extension, the nightly rate used for your extension can differ from the nightly rate used in your original booking. Primetrack Short Stay will always notify you when this is the case and ask for your approval before finalizing the requested extension.

15.4. If the guest wishes to alter the booking (for example change of the dates or change the stay to another rental property) Primetrack Short Stay will endeavour to facilitate this.
